These Terms of Service ("Terms") are a legal agreement between you and Steepmaps ("Steepmaps," "we," "us," or "our"). They govern your access to and use of Steepmaps's mobile apps, websites, desktop applications, maps, data layers, and related services (the "Service").
By creating an account or by accessing or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms. If you use the Service on behalf of a company, organization, or other entity, you represent that you are authorized to bind that entity, and any reference to "you" in these Terms refers both to you and to that entity.
You may use some parts of the Service without creating an account. If you create an account, you agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activity that occurs under your account and must notify us promptly at support@steepmaps.com if you believe your account has been accessed without authorization.
We may suspend or terminate your account or access to the Service as described in Section 18.
Steepmaps is a mobile and online platform for mountain and backcountry enthusiasts. The Service allows you to view and configure maps and layers, organize and visualize activities and adventures, and access content contributed by Steepmaps, independent professionals, and other users.
As described in Section 4, Steepmaps is not a guiding service, an emergency service, a safety authority, or a substitute for professional training, on-the-ground terrain assessment, or official bulletins such as avalanche and weather forecasts. All content in the Service is provided for general informational purposes only and does not constitute guiding, instruction, or safety advice.
The Service may feature content created or curated by independent guides, professionals, athletes, subject-matter experts, organizations, and community members ("Contributors"). Unless we explicitly state otherwise, Contributors are not employees, partners, or agents of Steepmaps.
Contributor content is informational only. Your use of such content does not create a guide–client, instructor–student, or any other professional–client relationship with Steepmaps or with any Contributor. Any guiding, instruction, safety services, or commercial activities you arrange directly with a Contributor outside the Service are solely between you and that Contributor. Steepmaps is not a party to those arrangements and does not supervise or control any on-the-ground activities of Contributors.
To the fullest extent permitted by applicable law, Steepmaps and the Contributors disclaim liability for loss, injury, or damages arising from your use of or reliance on Contributor content.
Mountain and backcountry travel is inherently dangerous. Risks include but are not limited to: avalanches, rockfall, crevasses, glacial hazards, rapidly changing weather, extreme temperatures, falls, equipment failure, getting lost, wildlife encounters, remoteness, lack of medical care, delayed or impossible rescue, and the actions or omissions of other people.
Steepmaps does not provide guiding or emergency services and cannot be used to contact search-and-rescue, medical, or other emergency responders. Connectivity, GPS, and device performance may be poor or unavailable, especially in remote or mountainous terrain. The Service may be inaccurate, delayed, or entirely unavailable. Use of the Service does not mean that a route, area, or activity is safe, appropriate, legal, or within your abilities.
By using the Service, you acknowledge that you understand and voluntarily accept all risks associated with mountain and backcountry travel, including risks resulting from errors, omissions, or unavailability in the Service or its content.
You agree not to rely on the Service as your only source of navigation, route planning, or terrain assessment. You will use backup navigation tools and consult official sources such as avalanche forecasts, weather bulletins, and land-manager notices. You remain solely responsible for your decisions and compliance with all laws, closures, and access rules.
To the fullest extent permitted by applicable law, you release Steepmaps and its officers, directors, employees, contractors, agents, licensors, and Contributors from any and all claims, demands, damages, losses, and causes of action arising out of or related to your use of the Service or any activities you undertake in reliance on it, including claims for personal injury or death.
Routes Provided by Steepmaps: Steepmaps may provide suggested routes, tracks, lines, waypoints, and other navigational content through the Service. These routes are provided for informational and planning purposes only. You are solely responsible for evaluating whether any route is safe, appropriate, legal, and within your abilities before attempting it. Route information may be inaccurate, outdated, incomplete, or unsuitable for current conditions. Conditions in mountain and backcountry terrain change constantly due to weather, snowpack, erosion, access changes, and other factors. A route that was safe at one time may be dangerous or impassable at another. You must independently verify all route information, assess current conditions on the ground, and make your own decisions about whether to proceed.
User-Submitted Routes: Any route, track, line, waypoint, or other navigational content you submit to the Service may be used by Steepmaps to create, inform, improve, or refine public routes available to all users of the platform. By submitting route content, you grant Steepmaps the right to aggregate, analyze, modify, and incorporate your submissions into publicly available routes, maps, and features, with or without attribution to you. This is in addition to the license granted in Section 7 (User Content).
The Service uses maps, digital elevation models, imagery, avalanche and hazard layers, access and road-status information, and other geospatial data from Steepmaps and third-party sources. These data may be incomplete, inaccurate, outdated, or unavailable.
Steepmaps does not guarantee the accuracy, completeness, reliability, or availability of any maps, data, routes, tracks, lines, waypoints, boundaries, closures, or other content and has no obligation to verify, update, or maintain any piece of content. The presence of a line, route, or "popular" feature does not mean it is safe, appropriate, or legal. As described in Section 4, you must not rely on the Service as your sole means of navigation or safety.
"User Content" means any content you upload, create, submit, or share through the Service, including but not limited to routes, waypoints, photos, comments, reviews, and profile information.
You retain ownership of your User Content, subject to the license below. By submitting User Content, you represent that you have the necessary rights to it and that it does not violate these Terms or applicable law.
You agree not to submit content that:
You grant Steepmaps a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, display, perform, translate, distribute, and create derivative works from your User Content as needed to operate, provide, improve, and promote the Service. This license continues while your content is available in the Service and for a reasonable period thereafter in backups.
We may remove User Content that violates these Terms or that we determine, in our sole discretion, is inappropriate.
If you provide us with ideas, suggestions, or other feedback regarding the Service, you grant Steepmaps a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use that feedback for any purpose without compensation or attribution to you.
The Service and all content in it, other than User Content, are owned by Steepmaps or its licensors. These Terms do not give you any ownership rights in the Service or its content.
Steepmaps grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Steepmaps app and to access the Service for your personal, non-commercial use or authorized internal business use. You may not copy, modify, distribute, sell, lease, or create derivative works from the Service or its content except as expressly permitted by these Terms or with our prior written consent.
You must use the Service lawfully and in accordance with these Terms. You may not:
Steepmaps may investigate suspected violations and may suspend or terminate access where it reasonably believes a violation has occurred.
If you purchase a subscription or other paid feature ("Subscription"), additional terms may apply.
App Store Purchases: If you purchase a Subscription through an app store (such as the Apple App Store or Google Play), billing, payment, renewal, cancellation, and refunds are governed by that app store's terms and policies. You may need to manage or cancel your Subscription through your app store account. Steepmaps does not control app store billing processes. The app store provider is a third-party beneficiary of this Section and may enforce it against you.
Unless stated otherwise, Subscriptions renew automatically at the then-current price until cancelled. Where required by law, we will provide notice of price changes and an opportunity to cancel before the new price takes effect. Applicable taxes may be added to the price.
If we materially discontinue the Service or a core paid feature, we may offer a pro-rated refund or other remedy as permitted by law and app store policies.
Steepmaps does not guarantee compatibility with all devices, operating systems, or network environments. Offline maps and data may be incomplete, outdated, or unavailable. You are solely responsible for verifying offline content before entering remote areas. Performance limitations do not create any warranties beyond those required by applicable law.
The Service may include, integrate with, or rely on third-party services, data, APIs, and content. Steepmaps does not control these third parties and does not guarantee their accuracy, availability, security, or continued support. Your use of third-party services is subject to their terms and privacy policies. Steepmaps is not responsible for any acts, omissions, or failures of third parties.
Steepmaps's collection and use of personal information is described in our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge that your personal information will be processed according to that policy and applicable law.
We may collect any information you provide or that is generated through your use of the Service. We may retain your information for as long as we deem necessary or useful for any lawful business purpose, including after you stop using the Service or close your account.
Your Rights: Depending on your jurisdiction (including under GDPR or CCPA), you may have certain rights regarding your personal information, including the right to access, correct, or delete your data. If you request deletion of your personal data, we will delete it in accordance with applicable law, except where retention is required for legal, security, or fraud-prevention purposes. To exercise your rights, contact us at support@steepmaps.com.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY.
TO THE FULLEST EXTENT PERMITTED BY LAW, STEEPMAPS AND ITS LICENSORS AND CONTRIBUTORS DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not allow certain warranty exclusions, so some of the above exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STEEPMAPS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ALL CASES, THE TOTAL AGGREGATE LIABILITY OF STEEPMAPS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND CONTRIBUTORS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO STEEPMAPS DURING THAT PERIOD, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
The disclaimers, exclusions, and limitations of liability in these Terms apply only to the fullest extent permitted by applicable law. Nothing in these Terms excludes or limits liability for:
If any exclusion or limitation is found unenforceable, it shall apply to the maximum extent permitted, and the remainder of these Terms shall remain in full force and effect.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Steepmaps and its officers, directors, employees, contractors, agents, and licensors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
If we choose to defend any such matter, you agree to cooperate with us in the defense.
By You: You may stop using the Service or request account closure at any time by contacting support@steepmaps.com.
By Us: We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if your use creates a material risk of harm or legal liability. Examples include but are not limited to: fraud, harassment, security threats, intellectual property infringement, or other unlawful or abusive behavior. We may also terminate access if we discontinue the Service.
Upon termination, your right to use the Service ends immediately.
Survival: The following Sections shall survive termination: 3, 4, 5, 6, 7, 8, 9, 13, 14, 15, 16, 17, 18, 20, 21, and 23.
These Terms and any disputes relating to them or the Service are governed by the laws of [State/Province], [Country], without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in [City, State/Province], under the rules of [Arbitration Provider], except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Nothing in these Terms prevents you from bringing claims in courts required by consumer protection law or from participating in class actions where such participation cannot be waived under applicable law.
You may request account closure at any time by contacting support@steepmaps.com. Upon closure, we will delete or anonymize your personal information from active systems upon request, except where retention is required or permitted by law or for security, fraud-prevention, or legitimate operational purposes. We may retain aggregated or de-identified data indefinitely.
We may change, suspend, or discontinue any part of the Service at any time without notice. We may update these Terms by posting the updated version to the Service or by notifying you by email or other reasonable means. Updated Terms take effect when posted or on a later specified date.
Your continued use of the Service after updated Terms take effect constitutes your acceptance of those Terms. If you do not agree to the updated Terms, you must stop using the Service.
Notices: We may notify you by email to the address associated with your account, by in-app message, or by posting notices within the Service or on our website.
Entire Agreement: These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and Steepmaps regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.
Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.
No Third-Party Beneficiaries: Except as expressly stated with respect to app store providers in Section 11, these Terms do not create any rights for any third party, and no third party may enforce any provision of these Terms.
